However I personally thought that there are some things that you could of changed to make it better. At the beginning I think that the voice over off the radio, which informs us of all the information, is very useful. Edward Earl Johnson was convicted of the 1979 shooting death of Walmet Grove Marshall J. P. Crest. Johnsons attorneys say theyve got a strategy to save the inmate from execution on the 20th May. You get the initiative that you are there in Mississippi going to see the Edward Earl Johnson. Before I watched your documentary I had my own preconceptions about death row and the people who were on it. I thought that it was a place where very evil people were put when they have committed a serious offence, I felt that all the people here deserved to die and that I had nothing against them being executed. When the helicopter is circling over the prison where Johnson is being held I think it would be a better idea to have a view of where the murder takes places. Then the narrator could read the information to the viewers. They would be able to see the place of the murder. Also during this it could show a view of the grave where the Marshall is buried. This would add an extra effect, letting viewers see the crime scene and then the grave. Furthermore when you are still having the view that you are I the car you can see black prisoners digging at the side of the road. I individually think that this is a good idea since we are all quite aware that places such as Mississippi in the South of America are still prosperous Ku Klux Klan areas. The things that I would change are first when you interview Edward Earl Johnson I think it would be better to have him in a cell. At the beginning of the interview you zoom in through the window of the cell into him as he is sat alone. Possibly having him sat in the room where he will be executed would be a very good effect, but this would be unfair on Johnson going to the place where soon he may be killed. He may become even more defensive about the murder, stating even more that he is not guilty because seeing where he may die could frighten him. If you were however allowed to do this and Johnson did not decline this then it would have a very good effect, it would make people understand the seriousness, that he will die here if justice is not done correct. I also would not let the interviewer be seen. You could also have a view of Edward Earl Johnson through the bars of the cell. This would let people see him in prison behind bars as he is, and I also think that it would give a mysterious effect, did he do it or didnt he? If it was necessary to see the interviewer then you could see him while he asks a question but then go back to focusing on Edward Earl Johnson while he answers. This is an effect used often on television shows, and in my opinion looks good for interviewing a person.

Introduction The 12th Century saw the move away from the Romanesque architecture which had typified the preceding centuries to the era of the great Gothic cathedrals which were to become the architectural symbol of the middle ages. The transformation was not simply one of size or scope but a manifestation of the cultural shifts which were occurring as the medieval age commenced. By this time, numbers and geometry had acquired a metaphysical significance and were believed to have occult symbolism and power. The introduction of sacred geometry into all aspects of the design of places of worship was therefore inevitable and from that time key design features such as the numbers of pillars in the choir, the layout of the floor plan and faà §ade were significantly influenced by the perceived significance of these theories. To understand in more depth how numbers and geometry were incorporated into architectural design it is interesting to first consider the characteristics of gothic architecture and in particular why they were such an influence on cathedral design. I will in the following use Chartres cathedral in France as an example which illustrates the impact of these influences. Political and Economical Background During the 12th Century, for the first time since the end of the Roman Empire, cities once again began to grow. Their wealth this time was built on the robust economic structures around banking and trade, rather than on conquest and slavery which had characterised the previous centuries. Financial wealth was emerging as the determinant of social standing rather than the historic influence of the church and preceding empires. The belief that geometry and number was a link to God was so strong that it influenced the Gothic style in a number of ways. Maybe it is this fact that mathematics was so intentionally incorporated, is one of the main reasons why these cathedrals remain such a great importance to us so many years later, not only as a place of worship, but also as a work of art.

Both of these men contrast one another, and fight for power, influence, love and attention in her life. Because both Edgar and Heathcliff both represent contrasting forces in the novel, they are unable to work together or act amiably towards one another. The goal of each one is to remove the other from Cathy's life. After Catherine's death, Heathcliff attempts to sneakily remove the lock of Edgar's hair enclosed in the locket about her neck and replace it with his own.In â€Å"open[ing] the trinket, and cast[ing] out its contents,† (145) Heathcliff believes that he has won this battle with Edgar. Symbolically, this action represents Heathcliff casting Edgar out of Catherine's life and heart, and filling the space with himself. Heathcliff walks out of the room believing that Catherine's body will be put to rest with only h is lock of hair on her, meaning that he will be with her for the remainder of her physical existence on this world. However, Nelly steps in and intertwines Edgar's hair with Heathcliff's.Both Edgar and Heathcliff live their lives believing that Catherine is holding a lock of only their own hair in her coffin, thinking that they are the only one who will be with her in death. However, Nelly's actions represent the fact that despite the two men's efforts of trying to win Catherine to themselves wholly, even in death, that Catherine holds both of them in her heart, and that neither one cannot be completely cast out. As Catherine is discussing the nature of her love for both Edgar and Heathcliff, she reveals a doubling within her personality.She says, â€Å"Nelly, I am Heathcliff,† (70) and continues on to say that any separation between them â€Å"is impracticable. † This revelation reveals a lot regarding their relationship, and how the two of them seem inseparable throu ghout the novel. It explains why Catherine allows Heathcliff to repeatedly come back into her life even though the sheer mention of his name perturbs Edgar's composure. The double that is Catherine/Heathcliff explains why Heathcliff is constantly a part of Catherine's life.For Catherine, Heathcliff is less of a separate person, a different entity, but more of a projection of her personality. Heathcliff represents the wild, naturalistic aspect of her personality, which has been suppressed by her change into a civil, upper-class person. As such, this suppressed personality returns in waves, exhibited both in her fits, and Heathcliff's unrelenting visits, refusing to be put out like the fire Edgar regards it to be. The reoccurring theme of doubles is at its strongest within chapter 15 as Lockwood begins narrating the story to the reader from Nelly's perspective.To clarify, the events have already been recounted to Lockwood through Nelly, and now he is narrating the story after she has told it to him, through her perspective, â€Å"She is, on the whole, a very fair narrator, and I don't think I could improve her style† (134). Needless to say, the reader is experiencing the story not secondhand, but thirdhand. Also, Nelly has already been revealed to be an unreliable narrator, as well as Lockwood. Combining the two is certain to have a profound effect on the story itself. The narration of the story has already had a tone of gossip about it, especially since Nelly called herself as a â€Å"gossip† (53).Now the ‘he said she said' essence of the story takes its strongest form, as we, the readers, are hearing about it ‘through the grapevine. ‘ Bronte uses this doubling of narration to emphasize the removal of the reader from the events in the story. The shadow of doubt the novel has been shrouded in is now a level deeper and darker than it has been up to this point in the novel. Nelly's biased narration of events, whose memory is blurred by time, is now coupled with Lockwood's own character flaws of misjudging characters and is subjected to his own bias as he recounts the already recounted tale.Within the novel, the relationships between servants and masters are anything but traditional ones. One would expect a servant to respect their master, and keep their tongue in check, however Nelly Dean seems exempt from these expectations, causing the reader to question who is the true master and servant within the household. On page 102, â€Å"[Catherine] rang the bell till is broke with a twang,† however, rather than rushing in as most servants should given the franticness of the bell ringing, Nelly â€Å"enter[s] leisurely. † This singular event provides a plethora of insight into the relationship between master and servant.The reader is able to discern that, since it is Nelly recounting the story, she would have no knowledge of the events happening in the room prior to her calling unless she was not alread y within earshot. Therefore, Nelly already knows the nature of the confrontation going on between Edgar and Nelly, and how it is of importance. Yet still, Nelly â€Å"leisurely† enters the room, flaunting her knowledge that Catherine needs her on a level beyond that of which a master typically needs a servant, and also spiting her by deliberately taking longer to arrive.However, during her narration of this scene, the reader can see building emotion within Nelly just within the paragraph this quote is taken from. It is clear that Nelly's â€Å"temper of a saint† is strung tight by Catherine's â€Å"senseless, wicked rages! â€Å"(102) And as a result of this emotion that she is not entirely able to control, Nelly's narration of this particular scene may be more unreliable than usual, as she might be tempted to exaggerate Catherine's behavior in order to justify her anger with her to Lockwood more, so that he may agree with her, or so that she may feel that he does.Di ction Log: 1: â€Å"Will you say, twenty years hence, ‘That's the grave of Catherine Earnshaw. I loved her long ago†¦ † (137) Synonyms: Linton Catherine's choice of calling herself Linton reveals much about how she views herself in terms of her identity. The reader also knows that Bronte is referring to Edgar because the reader understands that Catherine is not truly a Linton, and not entirely Edgar's.Bronte's word choice symbolizes a growing emotional distance between Edgar and Catherine, terrifying Edgar not only for the sake of her safety, but also for their relationship. Since Bronte's word choice reflects Nelly's disposition, it is also made known to the reader that Nelly sees this growing distance, and development of Catherine's character. 3: â€Å"Thought I hate him as much as ever, he did me a good turn a short time ago that will make my conscience tender of breaking his neck. † (75) Synonyms: fond, delicateOf the possible synonyms that could replace the word tender in this context, â€Å"tender† conveys the meaning of what Edgar is saying best. While â€Å"sanguine† has no direct link to blood, through definition or synonymously, the root of it is linked to blood. The verb animate is traditionally used to describe an inanimate object coming into motion. During her fits, Catherine is often likened to an inanimate object due to her habit of fainting, or becoming immobile. (103) Synonyms: conversation, audience, exchange The use of the word interview enhances the meaning of the quote in that it provides a certain depiction of the exchange between Edgar and Isabella. Bronte's choice of the word interview conveys that it was not an amicable, two-sided conversation. The use of the word examination is more effective than â€Å"inquiry† or â€Å"interrogation† would be because of the tone that Bronte gives the nature of the conversation between them. Edgar is not an overly aggressive individual, and to interrogate his sister would be out of character for him. However, an examination suits Edgar's passivity because it conjures an image of a jealous lover trying to elicit information f rom their significant other, which is much like what Edgar is trying to do. 8: â€Å"Cheer up, you shan't be hurt!Your type is not a lamb, it's a sucking leveret. † (99) Synonyms: mouse, turtle I opted not to choose direct synonyms for leveret, which are rabbit, and hare, because these words do not change the nature of Catherine's insult. Bronte's diction here is likely due in large part to colloquialism of the time. However, the nature of Catherine's insult is rooted more in the fact that she is belittling Edgar as having the courage of a small animal more prone to flight, rather than to fight. Catherine chooses to call Edgar a leveret because of his predisposition to avoid and run from conflict, rather han to face it directly. A turtle retreats into its shell, whereas a rabbit will tuck its tail and run, exactly like Catherine is accusing Edgar of doing in this quote. This insult is particularly effect because Catherine is calling Edgar's manhood into question, which is not only uncharacteristic of a woman of the time, but she is also doing so in front of Heathcliff, effectively making a direct challenge to Edgar on both her and Heathcliff's behalf. Literary Criticism: â€Å"Will you forget me–will you be happy when I am in the earth? Will you say, twenty years hence, ‘That's the grave of Catherine Earnshaw.I loved her long ago, and was wretched to lose her; but it is past. ‘† (137) The goal of psychoanalysis is to interpret a character's (un)conscious desires by identifying Freudian concepts. An example of one of these such concepts is a Freudian slip, and one lies within the quote. Consciously or not, Catherine has called herself Catherine Earnshaw, despite her status as Edgar's wife, making her both legally and socially known as Catherine Linton. However, she has revealed in this Freudian slip that she does not emotionally identify herself as Catherine Linton, but as an Earnshaw.This is important because much of the confli ct up to this point has stemmed from Heathcliff's anger at Edgar taking Catherine from him, and in his struggle to win her back from him. Within this quote, Catherine subtly tells Heathcliff that she will die Catherine Earnshaw, meaning that she is rejecting the Linton name, thus ultimately meaning that emotionally, she is Heathcliff's. â€Å"Well, if I cannot keep Heathcliff for my friend, if Edgar will be mean and jealous, I'll try to break their hearts by breaking my own.That will be a prompt way of finishing all, when I am pushed to extremity! † (101) Within this scene, Catherine is venting to Nelly regarding her feelings regarding the conflict between Heathcliff and Edgar. In the quote, it is visible that Catherine is exhausted by their constant fighting, and the toll that it has been taking on her. Out of context, the claim the Catherine makes concerning her ability to â€Å"break their hearts† seems conceited, however, from a feminist perspective, this statement is substantial.For a novel written in this time, it would be rather uncommon for a woman to be depicted as having power over a man, much less two of them. While Catherine does appear to be selfish, and conceited in this quote, she is depicted as essentially having control over the two men, in that she has the ability to â€Å"[finish] all,† establishing the force that Catherine is able to exert in both of the relationships. The poem American Me, written by Ninfa Miranda-Maloney, tells the story of a Mexican immigrant who comes to the United States to live the American dream. The author incorporates ethnic aspects with her use of Spanish words sprinkled in amongst the poem. With his â€Å"spit shine shoes† (Miranda-Maloney, n. d, line 10) and â€Å"brillantina-slick back hair† (Miranda-Maloney, n. d. , line 11), a picture is painted of a young man’s pride in himself as he begins the journey of a lifetime. This is a young man ready for his new life in America. The tone quickly changes, however, as he probably soon realizes that the dream is not what he had in mind. In San Eli, where he â€Å"lived on thank yous and maybes† (Miranda-Maloney, n. d. , line 23), the reader gets the sense that the man was taken advantage of and worked hard for little compensation. The most powerful lines in the poem are â€Å"kissed your white land, broke my back, sweat a few tears for a piece of the dream† (Miranda-Maloney, n. d. , lines 27, 28, 29). The author has incorporated a racial aspect in the poem by showing referring to the white land. This is not his land, this is the â€Å"white land†. He is doing back breaking labor for â€Å"whites†, probably not what he expected as the young man full of hope chasing the American dream. The author also includes social class aspects in this poem. The poem ends with the man, now here in the United States for fifty years, still smelling the onions on his fingertips. (Miranda-Maloney, n. d. ) This leads me to believe the man is still working in the onion fields fifty years after arriving in the United States. A generalization can be made that a person from a lower social class would need to continue to work past retirement age to make ends meet. I grew up in a poor neighborhood in California. My community included many immigrants here in the United States both illegally and legally. The immigrants I have known throughout my life are generally proud Americans, though there are the few that grow bitter because their American ideals and dreams have not been met. They work hard doing difficult work for little money and not much appreciation. While I don’t personally identify with the poem, I am able to sympathize with the character as he could represent a number of people I know. My grandmother emigrated to California before my mother was born. She came to the States with the dream of giving her children a better life than the one they’d likely have in El Salvador. Throughout my life, she’s told me the stories of moving here and settling the family in the area. It was difficult for her, working many hours as a maid, but she did it for the benefit of her children. Many times throughout her first few years in the states, she considering going back home. The dream she envisioned was hardly her reality at first. I can’t imagine how difficult it would be to go to a different country where you don’t speak the language or know the culture but it happens regularly in this country. At the end of the day, the United States is a country made up of immigrants, most of which are just chasing the dream as well.

This is why it is important to know for yourself how you go about making ethical decisions, or decisions of any kind. Finding out how one goes about making decisions can be a rather hard task as I found out while I was researching my mind to ?decide? exactly how I do go about making the decisions I make. The first thing I decided was that most of the decisions I make in my life are made with much thought about anything that might be affected by the decision. The most important thing, to me, is to make a decision and have reasons. I have to know why one choice is better than another. I feel compelled to look at every angle to assess what will be the outcome. I, personally, have a hard time making ?spur-of-the-moment? decisions especially if it involves something rather important to me. Many things! go through my mind and trust in my practical intuition (notice I didn?t say ?blind? intuition) also plays an important part. I make decisions based on different things depending on what kind of decision I am having to make, but there is always one ultimate source for my decision making that supersedes all other ?sub-categories? that influence my decision making, and that does not change, regardless of the situation ? and that is God. To me, God is the supreme ethical teacher and giver of wisdom, and if this is true then when searching for wisdom, why shouldn?t I look to the originator of wisdom. God is my number one influence in any decision that I make. My love for Him and faith in His power causes me to adhere to His will and actively search out the text of the Bible in order to learn more about the way He wants me to live and the things He wants me to have in my heart and in my mind as a guide for myself when making decisions. It is through this searching that I have discovered which ethical principles are important to me and how to adopt them as my own. One does not have to be a Christian to have ?values?. Everyone has a primary source from which they draw to make decisions and it is often their values. The important thing is how or where you obtained your values. Are they yours or did someone else just pass them down to you. I have values, but the values I hold in my heart are not merely of tradition passed down to me, but spring from a diligent study of the Bible, which again comes from my love of the Father (which by-the-way, exists because of His great love for me). So, in this light, for me as a Christian or a non- Christian, values provide the very motivation for decision-making in the first place. I therefore decide to make decisions for myself because I want my life to adhere to the values that encompass my heart. I want to live my life constantly aware of the presence of God, and therefore, train my thoughts to become value-focused, and since the values in my heart are an extension of the Father, then I ough! t always to ask myself ?What have I done that is as God wills and what have I left undone of that which He does not will. Another word that has a similar connotation as the values that I am discussing is virtues. Virtues are ideal character traits that people should incorporate into their lives such as: honesty, loyalty, respect, etc. For myself, this also is primarily obtained from my study of the Bible. I need to address the fact that in growing up in a family that held strongly to the values or virtues it was taught by their parents, that it is, in fact, nearly impossible not to be influenced by these things that were taught in the family, whether they were bad or good, and say that all values and virtues are entirely my own and have originated within me. An organization is a group of people who work independently towards a common goal. Organization achieves their goals by creating, communicating, and operating the system existing in every organization. To better organize and manage the organization, manager needs to understand the element of the social system, role and role conflict, as well as the culture of the organization. In this assignment, we were asked to study a case regarding the role conflict and culture that were faced by Amir as a management trainee at a well-established organisation which at the same time, he is a husband and a father of two children. Based on the study case, we found out that Amir is facing with inter-role conflict, personal-role conflict, role overloads and role ambiguity. All these role conflicts must be solved professionally as it can affect Amir’s work performance and the perception of the organizational members towards him. In order to resolve these problems, Amir has to study the changes t hat happen in the culture of the organization as he needs to adapt with the new environment. There are two types of cultural changes in organization, that are the cultural revolution and the cultural evolution. In Amir’s case, he is confronted with the cultural revolution. If yes, identify the kind of role conflict Amir is facing. Role is when someone understands the relative importance of those tasks, in other words, they know the priorities of their various responsibilities, while role conflict is a situation in which an individual encounters  deviating role expectations. In my opinion, yes, Amir is facing the problem of role conflict that consists of inter-role conflict, person role conflict, role overload and role ambiguity. Below is the explanation about these role conflicts in this case. I. Inter-role conflict Inter-role conflicts occur when an individual occupies more than one role with inconsistent expectations. In other words, certain role with expected of a person are in conflict with the other roles that the person holds. For example, Aminah has a class-mate that wants to lodge at their room for one day but the room-mate disagree because they have their own rule which is not outsiders are allowed to stay in the room. In this situation, Aminah has to faces the conflict on which role should be performed whether as a class-mate or a room-mate. In Amir’s case, Amir as a husband does not know how to manage time between the family and the company. Amir was required to do all kinds of work until he has become a workaholic. In the same time, Amir was not able to give sufficient time to his family as he devoted most of his time working even on Sundays. II. Person-role conflict Person-role conflicts may define when a role holder is required to perform a role that contradicts or violates the role holder’s attitudes, beliefs and behaviors. As an example, when a staff expected to punch card for his friend, indirectly it may contradicts the staff attitude and beliefs where by a staff in the company should not to punch card for the other staff except themselves. Throughout Amir’s case, Amir has to assign with various other roles and was required to coordinate and communicate with diverse groups of the workforce.  However, the team members do not want to give full cooperation in fulfilling the tasks. Indirectly, was scolded by the boss for errors committed by other team members. III. Role overload Role overload occurs when there is a lack of balance or reasonableness in the number or the extent of expectations from a role holder. It also happens when the expectations sent to a role holder are unmanageable and there is not enough time for the role holder to perform all the roles expected of him or her. For example, where a student is expected to study while at the same time expected to do part time job. As a student, they must expect to perform some other roles even though it is impossible to be done in the same time. In this case, it’s similar with Amir which is he was required to do all kinds of managerial task from conducting office correspondence and conducting business meetings to solving the complaints of customers and subordinates. As time passed, Amir became more efficient and performed various roles in increasing effective manner. IV. Role Ambiguity Role ambiguity occurs when there is lack of clarity in understanding what expectations or prescriptions exist for any given role. A role holder lacks sufficient information in performing the role. This results in the role holder feeling unsure on how to act in his or her role. As an example, a new student in second intake was entered in the university and they did not receive complete information regarding the subject or any related activities. Indirectly, the student’s do not sure how to act in his or her role. In this case, the first few months on job Amir have to faced on stress which  is he was entrusted with limited tasks related to his area of expertise as a management. It is because the organization did not explained to him regarding his role as a management trainee. Question 2 What could be done to resolve his problem? For every problem, there will be solutions and ways to overcome. Amir who deals with many types of role conflicts can handle the problems well if he knows how to deal with it. I. Inter-role conflict In solving Amir’s dilemmas of role conflict as a worker and as a head of family members, the best way in dealing with these problems is he must know how to manage his time well. He also needs to understand and distinguish his responsibilities in holding both roles. Amir should avoid working on weekends as that is the only time to have a good time with the family members. This is to make sure that at the same time of being a dedicated worker to the organization, he can spend his quality time with his family members as well. II. Person-role conflict As a former Management Executive, for sure Amir will expect the task of management trainee would involves his area of expertise that is, management. However, different roles were assigned to him. In solving this matter, Amir should confront with his superior and ask for a good explanation regarding his exact tasks that he needs to fulfill. He also should stand for his right if he was scolded for errors not committed by him. In my opinion, even though the tasks given are not in his area, Amir can take the tasks as a new thing to learn. III. Role overload As a worker, the tasks given by the superior is a must to do but, if Amir thinks there is a lot of work to be done in a time, he should suggests his superior an assistant if possible. Amir should not be stressful with the multi tasks given in order to maintain a good quality of work. If the superior could not fulfill his suggestion, maybe Amir could ask for higher pay. Even though money could not promise happiness and could not replace the time that he can be with his family, at least he would feel satisfied and appreciated for the job he done. IV. Role Ambiguity The transfer of information between the sender and the receiver is very important in an organization. Improper communication of information definitely will result misunderstanding between both parties. In solving Amir’s role ambiguity as he was not explained the role as a management trainee, what he should do is get a clear information on his role from his superior. Even though he has a strict taskmaster, he must be brave enough to ask and get the exact information from him. Or else, he should get the right information either from the seniors or other colleagues. Organization Culture is a set of assumption, beliefs, values, and norms shared by everyone in an organization. Organization Culture change in two ways, Cultural Revolution and Cultural Evolution. There are two main type of organization culture, and it is called dominant cultures and subcultures. It is appropriate to categories that the type of  culture that Amir works in is subcultures. This study begins by stating that nulla poena sine lege, meaning that no person may be punished except in accordance with the law. In every instance, there must be a law governing and prescribing punishment. Further to that non omne quod licet honestum est, meaning that not everything that is permissible or even lawful is honest or honorable. There are limitations in respect of this maxim. Finally, it would also like to state that apices juris non sunt jura or non congruit de apicibus juris disputare, meaning that legal principles must not be carried to their most extreme consequences, regardless of equity and good sense. This study deems it fit to address the issue of rendition within the three maxims mentioned there above. It is worth while to note that rendition is not only a legal issue but also an ethical issue, so to speak. Therefore this study will take into consideration several ethical theories to enrich the theoretical perspective of this study. The section on findings and discussion will give a critical synthesis between law and morality discussed in this study. This will also be the part where this study will give its own stance regarding ethics of rendition. Research Questions Q. To what extent can rendition be justified? Q. Is it justifiable in law and in morality? Literature Review This section will explore in depth the notion of rendition and its impact on contemporary society. It will look at how different governments feel about it especially in the United States. Rendition is defined as the act of shifting a person from one nation to another for imprisonment and interrogation through the use of torture, which would not be permissible if they remained in a certain country. Extraordinary rendition involves the transportation of suspected foreign terrorists or other persons suspected of crimes, to other countries for interrogation and imprisonment. Looking at the above definition one can already dismiss the rationale of rendition off-hand. Just before even getting to the aspect of torture in it, why would a government take advantage of another country’s laws? Why is it hard for such a government to enact laws friendly to rendition in their own country? There are so many other queries that need to be addressed here. It is believed that the aim of extraordinary rendition is to make suspects provide intelligence information by torturing them. These suspects are either sent to facilities sponsored by the US government or can be left in the hands of foreign governments. As mentioned earlier, suspects are transported to countries whose laws do not prohibit torture and abusive treatment. In this regard, extraordinary rendition allows acts of torture towards detained suspects notwithstanding the fact that torture is an offence, at least, under international law no matter the cost. This practice is believed to have begun back in 1990s but gained its momentum following the September 9/11 attacks on US. It is also believed that this policy re-appeared during the reign of Bill Clinton although it grew in strength during the reign of George Bush. It is estimated that 150 foreign nationals have been victims of torture as a result of rendition in the last few years alone. In most cases this foreign nationals have purportedly been suspected for terrorist acts. After their transportation, detention and interrogation takes place in countries like Jordan, Egypt, Diego Garcia, Iraq, Afghanistan, Egypt and Guantanamo. Robert Baer, the former CIA agent, is on record for having said that if one wants a serious interrogation then the culprit should be sent to Jordan. If the aim is to torture them then the best place would be Syria and if the aim is to make a victim disappear and never to be seen again, then the best place would be Egypt. There are allegations that US intelligence agencies have sent terror suspects for interrogation by security officials in different countries. By so doing, they put them in a situation where they cannot be protected by the American Law. Some persons confess that they were flown to countries like Syria and Egypt by CIA agencies where they were tortured. The US government and its intelligence agencies believe that their operations are legally justified. Even though US officials agree that terror suspects have been transported to other countries for interrogation, they vehemently deny that acts of torture take place when they get there. The former US Secretary of State Condoleezza Rice is on record for having said that all American interrogators act within the UN Convention on Torture. She went further to state that they adhere to this Convention while exercising their duties in US or in another country. There are several documents that detail human rights legislation, for instance: (a)Third and Fourth Geneva Conventions (b) Universal Declaration of Human Rights (UNDHR) (c) United Nations Convention Against Torture (UNCAT) and (d) US Constitution. Surprising enough is that US government is a signatory of each of these treatises. This study believes that by the fact that United States identifies with the principles in each of these documents it should be the first nation to safeguard victims against acts of torture. Nonetheless, the impression is that US promotes extraordinary rendition in the name of war on terror. Then why would one not accuse US government of hypocrisy or cynical relativism in terms of its commitment to human rights and civil rights laws? Moreover, the fact that US are a signatory to the abovementioned documents it needs to terminate programs that violate human dignity. The Third and Fourth Geneva Conventions The Geneva Convention set the standards for international law as far as humanitarian issues are concerned. Its central concern was the treatment of civilians as well as prisoners of war. Its principles safeguard against human rights violations and establish universally acceptable standards and approaches relating to detained victims in times of war. The Convention forbids any form of physical or mental torture or any other kind of coercion towards suspects in a bid to gather information from them. It further states that even if the prisoners fail to open up during the interrogation process they should not be intimidated or abused or maltreated for that matter. The Universal Declaration of Human Rights The fifth article in the Universal Declaration of Human Rights states that â€Å"no person shall be put to torturous acts or inhuman treatment or punishment†. Apart from providing an injunction against torture it further restricts the utilization of â€Å"degrading treatment or punishment†. In the sixth article, it states that every person has a right to recognition before the law no matter where the person is or could be. The eighth article invalidates the CIA’s practice of â€Å"extraordinary rendition†. This article states as follows: â€Å"Everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law†. This study believes that whenever prisoners are transported to other countries chances that this protocol will be observed are quite minimal. The ninth article prohibits the arrest of persons with no proper justification, including detention or exile. This provision prevents United States from carrying out extraordinary rendition activities. The tenth article essentially invokes what in Latin can be termed as habeas corpus which literally means that one may have the body. It is a writ ordering a person to be brought before a court or judge so that the court may ascertain whether his detention is lawful or not. United Nations Convention against Torture This convention has an international scope on human rights protection. This Convention is greatly endorsed by the United Nations and its observance is extremely mandatory for all the member states who are signatory to it. As mentioned earlier, United States is a signatory of this document so it has no option but to adhere to its provisions. This Convention states that all signatories should create appropriate measures to safeguard against torturous acts within their territories and prohibits countries from transferring persons to other countries so that they might torture them. Article two states that every state ought to exercise appropriate legislative measures, administration and judicial measures to fight any elements of torture under its jurisdiction. It further states that under no circumstances can torture be justified. The circumstances could be a state of war or a threat of war or public emergency. It also does not matter whether such orders come from the top officers, torture remains unjustified. In article three it states that no person may be transported to another state to be interrogated or tortured simply because that country’s laws allow it. The Constitution of the United States It is quite impressive to discover that the practice of extraordinary rendition is not only prohibited as seen in the three Conventions discussed above, but the US constitution is against it as well. The Fourth, Fifth, Sixth and Eighth Amendments are a clear indication that US holds a no-policy towards extraordinary rendition. These amendments prohibit arbitrary search and seizure of individual and/or property; it also invokes the right to due process of law, as in, the concept of habeas corpus mentioned above. In this light, US government contradicts the spirit of its constitution whenever they indulge in extraordinary rendition. Deontology versus Utilitarianism Deontological moral theory is also a Non-Consequentialist moral theory. While consequentialists believe that the end always justify the means, deontologists assert that the rightness of an action is not simply qualified by maximizing the good alone, it must be that the action fulfils what is considered moral. It is the inherent nature of the act alone that determines its ethical standing. Or better still, utilinitarianism believe that one should always exploit the good in his/her actions while deontologism believes that it is not the pursuit of the good but it is the moral worthiness in the act. Virtue Ethics is not much concerned with rules, consequences and specific acts but it puts more emphasis on the subject of the actions. In other words, it is interested with the person who is responsible for acting. It holds that acting in accordance with given rules; or analyzing the good outcome of the actions is not what should only count. The most primary thing is whether the subject of the actions, in this case the individual, exhibits elements of good character or moral virtues or not. Unlike utilitarianism which is concerned with the maximization of the good in performing a given act, virtue ethics instead, focuses on the moral quality exhibited by the agent of the actions. Therefore, the dictum that the end justifies the means has no place in virtue ethics. On the other hand, deontologism is somehow a normative approach to ethics which typically evaluates the actions of an individual in relation to moral standards in the objective order. Both utilitarianism and deontology focus on the actions of the agent contrary to virtue ethics which is a complete turn to the subject that is acting. Findings and Discussion Throughout this study it can be seen that there is no where that extraordinary rendition has been justified. The reader taking part in this study can clearly ascertain that rendition has no place either in law or in morality. Furthermore, it cannot be justified no matter the circumstance. This study however believes that persons who destabilize peace and stability should be dealt with accordingly. In any way, they should be eliminated in the society. Looking at the intention of extraordinary rendition, it stands justified in that it serves as a deterrent kind of punishment. Literally, it makes the culprits pay for the wrongs they have committed. In the contemporary society crime cannot be something that anybody will brush under the carpet, it is important that preventive measures be put in place. The Conventions discussed in this study clearly indicate that extraordinary rendition is an offence in law. Now, the problem is that this study does not understand to what extent each of these Conventions applies. It was stated very clearly that signatories to these Conventions are bound by them; so do these same Conventions apply to countries like Syria, Jordan or Egypt which are clearly the preferred destinations for acts of interrogation and torture. This study cannot fail to mention that most countries, or instance, Syria or Egypt are sovereign and with authentic constitutions. Could it be that their constitutions allow extraordinary renditions? Or is it that their laws do not care about such practices? This means that a country need not legalize torture but the fact that its laws say nothing about acts of rendition it becomes a reason to practice them. From a utilitarian ethical viewpoint, the end qualifies the means so long as the acts brings desirable end. This means that utilitarianism supports extraordinary rendition insofar as it will eliminate same crime occurring in the future. On the contrary, deontological ethical viewpoint believes that what should be investigated is the act itself not the consequences. As such, torture is immoral whether a nation recognizes it in law or not. This study confidently declares torture an immoral thing and something that should not be used as a form of punishment. Finally, this study would like to reiterate that the contemporary world needs to enact stiff measures to ensure that all criminals have been completely wiped out. No person should disturb another person’s peace. It also believes that due process of law is the best way to deal with criminals. Imprisonment in itself is maximum punishment since it denies such criminals opportunities for further commitment of crime. Conclusion This study has explored the meaning of extraordinary rendition and its implications. So far, there is no where in this study has it been justified. Much of its practice has been adopted by the United States government in its war on terror. From the Conventions it is clear that the practice of torturous acts remains entirely prohibited no matter the cost. It has also been indicated that the major proponents of extraordinary rendition, the United States for this matter, prohibit such practice in their constitution. This study has also highlighted two ethical standpoints namely deontologism and utilitarianism. Inasmuch as utilitarianism justifies the means due to the perceived good it does not offer any justification for extraordinary rendition. So, human dignity should be upheld at all times.
